Participants learn how to manage the key contract Risk Drivers: poor project evaluation/selection, scope of services problems and breakdowns in contract protocols. Through the use of claims data, and actual contract clauses, we will navigate the potential pitfalls in contracts for design professionals

Topics include:
1.)Learn the importance of project evaluation prior to entering a professional services agreement to ensure that all project participants have sufficient experience and capacity to carry out the project safely and effectively.
2.)Explore the role a full and clear scope of services plays in a successful project as well as hazards of not explaining the risks of a limited scope to an owner.
3.)Acquire tools to help manage the critical process of contract negotiation and administration to select the right people for the job of negotiating the contract and scope; to initiate the negotiation with their standard agreement; to diligently follow the same process for all contracts; and to obtain a signed agreement in every project.
4.)Review key clauses that can impact a project by limiting the insurance coverage available to respond to any errors or omissions that may arise during the design and construction process, including indemnities, certifications, guarantees and warranties, construction observation, jobsite safety, and construction means and methods.
